1. Your Acceptance
   By visiting 4FreeFiles.com website and/or using products, software, datas or services provided by 4FreeFiles (collectively the "Service"), you signify your assent to (1) this "Terms of Service" located at http://4freefiles.com/terms/, and (2) 4FreeFiles "PRIVACY POLICY", located at http://4freefiles.com/policy/, which are inalienable parts of this Terms of Service.
2. 4FreeFiles service
   4FreeFiles provides You with a legitimate paid technical solution, which enables you to upload, store, access and download text, software, scripts, images, sounds, videos, animations and other materials (hereinafter "Content") in form of one or several electronic files.
3. Restrictions
   
   1. You agree not to upload illegal Content on 4FreeFiles, including but is not limited to:
      • Content which infringes any copyright, patent, trademark, trade secret or other proprietary rights of any person;
      • Content which contains software viruses or other programming (code, scripts, active content, and other software) designed to disrupt or deny operation, gather information that leads to loss of privacy or exploitation, gain unauthorized access to system resources, limit the functionality of any computer software, hardware or telecommunications equipment and other abusive behaviour;
      • Content which violates legislation regarding the distribution of pornography, human and child exploitation, racism, manufacture or sale of weapons and/or illegal substances, or in any other way is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libellous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
   2. You agree not to cause any damage to the reputation of 4FreeFiles by any action or inaction.
   3. You will not to procure or assist any violation of this Terms of Service by any third party.
   4. You agree not to use automated programs or any scripts to access 4FreeFiles, unless expressly authorized by 4FreeFiles.
   5. You agree not to access Content through any technology or by means other than provided by 4FreeFiles.
   6. You agree not to alter or modify any part of the Service.
   7. In your use of the Service, you will comply with all applicable laws.
4. User Accounts
   1. You may voluntary register a user account on 4FreeFiles to receive additional Services and benefits.
   2. All user account information (including payment details and personal data) that you submit on 4FreeFiles is complete, true and accurate.
   3. In the event that any of your Account Information changes in any time the future, you agree to promptly update such information.
   4. You are solely responsible for the security of your password or passwords and agree to maintain confidentiality of your login names, passwords and other confidential information relating to your access to the Services.
   5. You agree not to transfer your login and password as well as other user access information to any third party.
5. Responsibility
   1. You are solely responsible for any information and Content you posted or uploaded to 4FreeFiles.
   2. 4FreeFiles is not responsible for information and Content posted or uploaded by you or any other user.
6. Warranties
   1. You agree that your use of the Services shall be at your sole risk.
   2. 4FreeFiles makes no warranties or representations about the Content or actions of any third party and is not responsible for:
      • errors, mistakes, or inaccuracies of Content,
      • personal injury or property damage, of any nature whatsoever, resulting from your access to and use of Services,
      • any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein,
      • any interruption or cessation of Services,
      • any bugs, viruses, trojan horses, or the like which may be transmitted to or through Services by any third party, and/or
      • any errors or omissions in any Content or for any loss or damage of any kind incurred as a result of the use of any Content.
   3. 4FreeFiles does not assume responsibility for any product or Service advertised or offered by a third party through the Services, featured in any banner or other advertising.
   4. You specifically note and agree that 4FreeFiles shall not be liable for defamatory Content, offensive, or illegal conduct of any third party. The risk of harm or damage from such Content rests entirely with you.
   5. You agree to indemnify and hold 4FreeFiles harmless from any claim, including reasonable attorney's fees, made by any third party due to or arising out of Content submitted or available via 4FreeFiles, or violation of any rights of any third party in regard to Content.
7. Miscellaneous
   1. You confirm that you are fully able and competent to enter into this Terms of Service and comply with its terms.
   2. The 4FreeFiles reserves the right in its sole discretion to modify or delete any information published, suspend, discontinue or restrict your access to the Service at any time for violation of this Terms of Service, any damage bared by 4FreeFiles or any other reason, without reimbursement of any payments with or without notice, without responsibility for any harm that you might be caused by such action.
   3. 4FreeFiles reserves the right to change or modify any of the terms and conditions contained in this Terms of Service, at any time, by posting new terms to the links as set in Cl. 1.1. You are responsible for regularly reviewing the policy. No amendment to or modification of this Terms will be binding unless you continue to use the Service after administration has posted updates.
   4. Any information, documents, products, logos, graphics, sounds, GUI, software rendered by 4FreeFiles (excluding Content) is owned by or licensed to 4FreeFiles, subject to copyright and other intellectual property rights under the law.
   5. You do have no right to use intellectual property of 4FreeFiles unless the usual use of Service or clearly expressed consent of 4FreeFiles;
   6. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
